$450k Settlement from Chesapeake Health & Rehab for Nursing Home Negligence

Chesapeake Health and Rehab Settlement

This case involved a nursing home wrongful death. The decedent was named Lois E. Chauvin who was a resident of Chesapeake Health and Rehabilitation Center. CHRC is owned by Medical Facilities of America, Inc. The allegations involved wrongful death due to poor trach tube care, as well as failing to monitor the oxygen levels in a high-risk resident.

Case Facts in the Lawsuit Against Chesapeake Health & Rehabilitation Center

Ms. Chauvin was admitted to the Hampton Roads nursing home as a trach-dependent vulnerable resident after she suffered a previous stroke. Tragically, she died of an anoxic brain injury from a lack of oxygen to her brain while a resident at CHRC. The plaintiff claimed that Chesapeake Health & Rehabilitation Center staff failed to use appropriate care and supervision with Ms. Chauvin, specifically ignoring her trach tube, suctioning her tube, and failing to monitor her oxygen saturation numbers. The defendants denied these allegations and refuted that they breached the standard of care.
