Frequently Asked Questions

What is ‘Neglect’?

Fort Lauderdale nursing home neglect is when a caregiver fails to meet the needs of the facility resident, and ignores the patient’s needs.

How do I know if my loved one’s injury was caused by nursing home negligence?

Nursing home negligence can be defined as a caregiver failing to provide something to the patient that he/she needs to maintain their health, safety, or dignity. This covers a wide variety of negligence. For example, ignoring a resident with dementia and allowing them to fall is a form of neglect. Another common example is failing to reposition a bed-bound patient, which results in skin breakdown and pressure injuries. Nursing home negligence encompasses both intentional acts, like abuse, as well as failing to supervise and assist the resident, i.e. neglect.

 How do you get paid?

Our Fort Lauderdale nursing home neglect lawyers only get paid if you make a recovery. We work exclusively on a contingency fee, meaning if you do not make a financial recovery, you owe us nothing. You will never be asked to pay us out of pocket. When the case resolves we typically take a fee of 33.3% to 40% of the gross recovery.

Who should be sued for nursing home neglect in Fort Lauderdale?

If the facility was negligent, the nursing home licensee can be held accountable for nursing home abuse. Also, depending on their involvement, corporate owners can be held responsible for nursing home injuries.

How can I transfer my loved one into a new Fort Lauderdale nursing home?

Chapter 400 of the Florida Statutes ensures that every resident has a right to be moved to a new facility if they’d like. The Fort Lauderdale area is home to more than 50 nursing homes. Determine which facilities can meet your loved one’s needs and then interview each location like you are looking for a job.

Can you explain the process in bringing a Fort Lauderdale nursing home negligence lawsuit?

If the nursing home injury took place in Fort Lauderdale, the claim would be governed by Chapter 400, which is Florida’s nursing home statute section. For an in-depth discussion on Florida nursing home abuse claims, the controlling law, and the process involved, please click here.

If you would like an in person meeting, our Fort Lauderdale nursing home negligence lawyers are happy to set up a convenient time and a place to meet, to go over your options.

What good will a Fort Lauderdale nursing home negligence lawsuit do?

While it is true that a successful Ft. Lauderdale nursing home lawsuit will not correct the harm done, it provides justice, closure, and financial compensation for the family. Further, a successful Broward County nursing home abuse lawsuit serves as a deterrent to the nursing home corporation, and corrects future bad behavior.

What if I live out of state?

If your parent or loved one was wrongfully injured in a Fort Lauderdale nursing home, but you live out of state, this is no problem. Everything we do can be done remotely.
