Understanding the Rise of Silver Spring Nursing Home Negligence
When considering good places to retire, chances are that Maryland has come to mind at least once. Dubbed “America in miniature” for its history and astoundingly diverse typography—from islands and wetlands to mountains and farmlands—word of Maryland’s appeal has spread, and the people have flocked in. As the most senior-friendly city in all of Maryland, Silver Spring has seen a lot of growth in recent years that has called for the construction of more nursing homes in and around the area.
Ironically, these nursing homes are one of the biggest and most unfortunate pitfalls in the Silver Spring area, as many have struggled to offer the quality of care expected by residents, their families, and the government. For such a senior-friendly area, elder abuse and neglect in nursing homes is far too common. The federal government keeps a list of nursing homes that have been cited for abuse, and one need only glance at Maryland’s record to see that many Silver Spring facilities are in poor shape. Others appear to perform well, but decent reviews or the absence of citations does not guarantee that you or your loved one is invulnerable to neglect.
If your loved has been abused or neglected while receiving care from a Silver Spring nursing home, Senior Justice Law Firm can help. Call us at 202-899-3111.
Low Quality in Silver Spring Nursing Homes
Silver Spring’s popularity spike can be partially attributed to its quaint nature and historic appeal. The city is home to several annual festivals, like the Jazz Festival, and has a walkability score of 98/100. There are a multitude of local shops and restaurants downtown for those who enjoy being out and about around other people.
Home to a stunning fountain and mosaic masterpiece by an award-winning artist, the Silver Plaza is a lovely outdoor space to socialize or rest. At the same time, avoiding the bustle of downtown is easy; Silver Spring has no shortage of parks and museums to explore. Matthew Henson State Park is one of many beautiful spaces that have paved walking trails through beautiful scenery.
Arguably, one of the best features of this area is how easy it is to travel elsewhere, as senior residents pay half price to board the Washington Metro or the MARC train. However, those wishing to relax indoors have plenty of nursing homes to choose from.
In fact, Silver Spring and its connecting areas are home to 17 nursing within just five miles of the city center, with nearly a hundred options available if you’re willing to go 25 miles out. However, many facilities struggle to achieve even an average score in government mandated health inspections, with more than a few coming in at the bare minimum Much Below Average rating.
Spotting Abusive Nursing Homes
In Silver Spring, one of the biggest issues that nursing homes face is in staffing. This is unsurprising, as understaffed facilities are a common problem nationwide, not just in Maryland. Additionally, approximately 70 percent of US nursing homes are run for profit and may overcrowd rooms with beds to maximize occupancy for monetary reasons.
Moreover, many nursing homes are understaffed. An attendee whose attention is split between no more than four residents will be able to provide excellent care, but with overcrowding and understaffing, it is common for one staff member to be responsible for over 30 residents.
Given the range of issues that plague these nursing homes, abuse and negligence is almost a guarantee. There have been instances of staff intentionally abusing residents, but this is rare. More often, nurses lack time to adequately care for their patients. When injuries or suffering occur in the absence of adequate care, it is called negligence. Whether harm is intentional or unintentional, the responsible facility can still be held accountable.
If you think you know someone who has suffered or passed away due to negligence, you may not know what to do next. One of the best things you can do is write down what you saw. Negligence is not always visible, but it commonly manifests as:
- Bedsores – A case that involves bedsores could be described as an open-and-shut case, as there are no medical conditions or situations other than neglect that result in bed sores. When a resident is static for a long period of time, bedsores develop as a result of the pressure exerted on the skin. To avoid bed sores, staff must simply assist residents in repositioning every few hours. Unfortunately, this responsibility is often ignored due to under-staffing. Bedsores are ulcer-like lesions that are incredibly painful no matter where they appear (the elbows, shoulders, and tailbone are common spots) and can reach down to the bone. If untreated, the skin will break open and turn into a hotbed for MRSA, sepsis, and infection—all potentially fatal conditions.
- Falls– If you notice that your loved is suffering from unexplained injuries, it could be evidence of multiple falls. In order to perform due diligence, nursing homes will strive to remove any and all tripping and falling hazards to prevent injuries (like slippery floors, uneven carpet, high door frame thresholds, and beds that one may easily roll out of). Residents may suffer from broken bones and brain bleeds (called subdural hematomas) if a nursing home fails to actively take steps to prevent residents from falling. Facilities that fail to take these critical steps are liable for the consequences of their negligence.
- Malnutrition/dehydration – It might be difficult to believe that eating and drinking can be one of the most dangerous activities in nursing homes. The danger at meal time lies in choking or things going down “the wrong pipe” (aspiration pneumonia). This can happen when staff do not spend sufficient time with residents as they eat and drink. Patients who have mobility issues are at an increased risk when left to their own devices at mealtime. Physical limitations and special dietary needs make residents more likely to suffer neglect. If the facility’s kitchen is understaffed, it may not be able to accommodate dietary restrictions. Further, those who cannot eat or drink on their own may be left alone with no way to consume what is in front of them. This can lead to malnutrition, starvation, dehydration, and even death.
- Physical and sexual abuse– It can be difficult to believe that your loved one has the potential to experience physical or sexual abuse while in a nursing home. For many people, it is quite shocking for them to learn that the people there to take care of and protect nursing home residents are capable of inflicting these injuries. The fact is that exhausted or frustrated staff members may lash out at uncooperative residents. This can occur even in facilities where staff are vetted during background checks. Other elderly residents may contribute to this issue as well. Memory loss or other cognition problems can make it difficult for some patients to interact with their neighbors in socially appropriate ways. Nursing homes are liable for any lawsuits that result from this behavior if they do not make every effort to stop it.
Available Damages in a Silver Spring Nursing Home Negligence Lawsuit
If you are considering filing a lawsuit against a nursing home, you may be wondering if it is worth the effort. At this point, it may seem fruitless—winning a lawsuit cannot heal your loved one’s pain. However, it is vital to recall the for-profit status of so many nursing homes. To seek monetary compensation in the form of damages is to ensure other residents do not suffer the same fate, as forcing facilities to pay damages is both a punishment and an impetus to address serious issues for the sake of avoiding future payouts.
No two nursing home abuse lawsuits are the same, but they often share common themes, which are listed below. Nursing home residents, or their grieving family, may seek damages for:
- Pain and suffering
- Loss of consortium (when someone is deprived of the family benefits of having a loved one, such as affection and sexual relations)
- Loss of enjoyment of life
- Distress, both mental and emotional
- Medical bills
- Loss of earnings
- Funeral costs (if a wrongful death has occurred)
Silver Spring Nursing Home Abuse News
Despite its growing popularity as a retirement location, Silver Spring (and Maryland as a whole) cannot seem to cope with the requirements of running a sufficiently staffed nursing home. Across the state, homes have been prioritizing monetary gain over patient care.
Attorney General Frosh noted in a recent investigation that homes “engage in unlawful and at times inhumane conduct in order to maximize the amount of money [they are] paid by taxpayer-funded public health insurance programs.” This can occur in a number of ways, but one recent example cites a home for evicting or discharging patients who were unable to live on their own. More than 1,000 people were victimized in this process before the responsible parties were shut down.
Thankfully, the administrator responsible for this behavior has been severely penalized and barred from operating any nursing homes in the future. However, this is just one step in improving the living conditions of elders in Silver Spring and beyond.
