Cape Coral, a city founded in 1958, began as a pre-planned community that has since grown to the largest city between Tampa and Miami.  With over 400 miles of navigable waterways, Cape Coral is a boaters paradise and thus a hot spot for retirees. In 2017, Forbes magazine named Cape Coral the #1 out of 25 fastest growing cities in America.  Cape Coral’s 2020 population is estimated to be 199,503 people with a median age of 47.9 years and 20% of the total population being over 65 years old.

Cape Coral Long-Term Care Facility Abuse and Neglect

When Kim Duda became a patient at Coral Trace Health Care in Cape Coral for rehabilitation after an operation on her foot, she did not expect her residency to end an infection. A year and a half after her original operation, after hopping around to different facilities in the Cape Coral area, Ms. Duda still cannot walk and requires a wheelchair.

“I came out worse than I went in,” Ms. Duda told the Naples Daily News.

Ms. Duda’s original operation necessitated a stay at Coral Trace Health Care. However, within six weeks at the facility, she contracted “a severe and contagious gastrointestinal infection.” That particular facility has an average rating of 2.1 out of 5 starts, has been cited a total of 97 times for violations, and fined $24,710.

Ms. Duda then went to a facility in Fort Myers, a city east of Cape Coral, where she was able to walk again. However, after a subsequent stroke, Ms. Duda was admitted into Consulate Health Care of North Fort Myers, where she found roaches everywhere and developed sores on her feet which led to the amputation of her two pinky toes. According to the Naples Daily News, Consulate Health Care of North Fort Myers has an average raging of 1.3 out of 5, has a total of 154 violations, and has been fined $32,500 by the state of Florida and $110,143 on the federal level.

Ms. Duda left the facility in November 2018 and still cannot walk but is hopeful that she will be able to in the future.

A Yelp review of Coral Trace Health Center also details the appalling conditions of this Cape Coral nursing home. The reviewer states that there seemed to be a lack of staff at the facility, and no one at Coral Trace Health Center was aware that the reviewer’s mother was to be transferred to their facility. This individual was also told that the staff could “take medications from other patients to get us through til morning when their on-site pharmacy opens.” Moreover, the reviewer found generally filthy conditions, with soiled bedsheets left for hours in a room. She also witnessed a resident asked for help for 20 minutes and after no response from staff, attempting to get out of bed, after which the resident fell hard onto the concrete floor. None of the five staff members helped the resident until a supervisor arrived.

Cape Coral Nursing Home Abuse & Neglect isn’t Isolated to One Facility

Not surprisingly, Consulate Health Care, which operates a nation-wide network of nursing homes – it’s the largest in Florida and the sixth largest in the nation – has come under fire for negligence and fraudulently billing government programs for care that was not provided to patients. In 2017, a jury awarded $347.8 million to several plaintiffs against Consulate Health Care, but the award was later overturned, “in part because [the judge] noted that nothing Consulate was accused of doing ever triggered action by state and federal regulators.”

The judge’s finding is both telling and disturbing. If state and federal agencies cannot be trusted to keep you or your loved ones safe which staying at nursing homes, what recourse is there?

This is why it’s so important to ensure that your rights, or those of a loved ones, are respected by nursing homes in Cape Coral and other cities in Florida. As reliance on state and federal agencies is insufficient and often ineffective to prevent negligence, private parties should keep an eye out for red flags, such as insect infestation, unexplained bruises, and lack of staff. Our firm can help address nursing home negligence or abuse and ensure that your loved one is receiving the care he or she is paying for and expects.
