Elderly Man Dies After Brutal Attack in D.C. Nursing Home, Deanwood Rehab

Resident Assault in DC nursing home leads to wrongful death

Deanwood Rehab & Wellness Center resident Dennis Stroy Junior died on March 20, 2022 as a result of injuries to his head. Mr. Stroy sustained permanent brain injury from a brutal attack perpetrated by a fellow nursing home resident. Mr. Stroy resided at the Deanwood Rehabilitation and Wellness Center in Washington, D.C., and the nursing home assault took place in the facility. Statements conflict concerning exactly what led to these injuries, which he received on February 21, 2022, about a month prior to his death.

Facts Surrounding the Beating and Subsequent Wrongful Death of Deanwood Nursing Home Resident Dennis Stroy

Mr. Stroy’s injuries arose out of a resident on resident fight inside the nursing home. The report from a social worker present at the wellness center claimed that Stroy was bleeding from his ear. Glaringly, these were allegedly the only injuries reported.

A nurse working a different shift explained to Stroy’s son, Allen Stroy, that his father had received various injuries due to an “altercation” with a roommate.

The police arrived at the nursing home at 3:27 a.m. and documented wounds to Stroy’s face and head. At the scene, Dennis’ face was beaten and swollen. He was taken to the hospital soon after the police’s arrival on the scene. Doctors at the hospital found internal bleeding in his brain, a cracked skull, and a number of other traumas. As a result of his injuries, Stroy was put on a ventilator.

Doctors also posited that, based on his condition when he arrived, Stroy’s injuries occurred several hours before his admission to the hospital—possibly between 11:00 p.m. the night before and 12:00 a.m. This suggests that there might have been a delay on Deanwood’s staff in finding Mr. Stroy, and/or reporting his injuries.

During the month between his injuries and eventual passing, Dennis Stroy could not even communicate with his family. He could only move slightly. He barely succeeded in opening his eyes.

This devastating loss was made more tragic by the fact that Stroy had just celebrated his 80th birthday the week before the incident. Family video shows him in good health and dancing with his grandchildren. Family also reported the creative life that Stroy led. Prior to his time at Deanwood, he travelled all over the Washington DC area doing wood carving. He was beloved by all who knew him.

In a statement, the Metropolitan Police Department stated they are “[i]nvestigating Mr. Stroy’s death and assault,” but are awaiting the Medical Examiner’s findings. Criminal charges may be filed depending on the pending investigation.

Getting the Truth as to What Happened to Mr. Stroy at Deanwood Nursing and Rehab

Police and reporters have tried repeatedly to glean more information about the events leading up to Stroy’s death. News stations contacted the nursing home by phone and email for a statement multiple times, but their inquiries received no response.

Since Stroy was unable to tell the police what happened, many details about the incident remain unclear. The officers at the Metropolitan Police Department have opened an ongoing investigation into this tragic event but await reports concerning the cause of death. Right now, it is not known who perpetrated the attack and whether they will face charges.

Overall, many questions persist, but Stroy’s family seeks justice for whoever attacked their father and grandfather. Stroy’s son Allen said, “We believe there was a crime committed. We know that it has to be proven, but we believe that my father would still be living had he not been attacked in his home.”

Analyzing Liability in a Resident Assault Case that Occurs in a Nursing Home

Nursing homes have a legal duty to keep vulnerable residents, like Mr. Stroy, safe. This means they have to keep the resident safe from themselves (i.e. prevent falls and self-harm), as well as safe from other residents. Nursing home regulations require that facilities screen out violent or aggressive residents, in order to prevent patient attacks, like the one that killed Dennis Stroy.

Our Washington DC nursing home abuse attorney routinely handles cases involving resident vs. resident, and staff vs. resident, assaults, attacks, and fights. In the case of Dennis Stroy vs. Deanwood Rehabilitation and Wellness Center, our law firm would investigate the violent propensities of the other resident. Should Deanwood have known he was violent? Was this assault foreseeable?

Sadly, many resident attacks are preventable through appropriate care. But to understand this, our firm gathers the medical records, takes witness statements, works closely with investigating police officers, and retains qualified expert witnesses.
