Duls Duckett, Mary E/O vs. The Windsor at Ortega
Allegations: Howard Duckett, the personal representative of the estate of Mary Duls Duckett, filed a nursing home negligence case against The Windsor at Ortega in March of 2022. According to the case complaint, Mary suffered from numerous falls at the facility. On around January 7th, 2021, Mary fell and was sent to the hospital. She was diagnosed with a subdural hematoma, also known as a brain bleed, a urinary tract infection (UTI), and a fracture to her pubic bone. She passed away on January 21st from blunt impact head trauma.
Mullen, JoAnn B. E/O vs. The Windsor at Ortega
Allegations: In August of 2021, Deborah Drennon Gervin, acting as the personal representative of JoAnn Mullen’s estate, filed a nursing home negligence lawsuit against The Windsor at Ortega. Ms. Mullen was oxygen dependent and used a nasal cannula. During the evening on May 16th, 2020, Ms. Mullen’s cannula was dislodged. Staff failed to check on Ms. Mullen during the night. Ms. Mullen passed away early the next morning due to the lack of oxygen.

January 14th, 2021, Inspection at The Windsor at Ortega
During an inspection at The Windsor at Ortega in January 2021, inspectors from the Agency for Health Care Administration, or AHCA, found that the facility had failed to conduct regular elopement drills with their employees. Elopement drills must be conducted twice a year to ensure all staff understand what to do in the event that a resident elopes from the facility.

Allegations: A nursing home negligence case against The Windsor at San Pablo was filed in July 2019. Billie Sue Jennings, the widow, and personal representative of the estate of Raymond Tillman Jennings, sued The Windsor at San Pablo following her husband’s passing. Within 15 minutes of being admitted to the facility, Mr. Tillman Jennings suffered a severe fall resulting in a fractured right hip. The facility failed to send Mr. Tillman Jennings to the hospital until three days after the fall. Due to the severity of the injury and delay in care, Mr. Tillman Jennings unfortunately passed away.

An inspection was conducted by AHCA at The Windsor at San Pablo in May of 2021. During the inspection, several deficiencies were identified. It was determined that The Windsor at San Pablo failed to conduct elopement drills, maintain accurate resident records, and ensure staff assisted residents properly with self-administration medications.

According to the complaint, while under the care of The Windsor of Bradenton Ms. Becker suffered from multiple falls resulting in a scalp laceration and right hip fracture. Additionally, she suffered from a stage one bed sore on her coccyx, a stage two bed sore on her bottom, a urinary tract infection, contractures of her left leg, and dehydration.

During an inspection conducted at The Windsor of Bradenton in late April 2023, it was determined that several employees had not received mandatory training in areas such as: infection control, safe food handling, reporting adverse events, facility emergency procedures, resident elopement, and incident reporting.
April 12th, 2022, Inspection at The Windsor of Bradenton
This complaint inspection concluded that staff at The Windsor of Bradenton had allowed a resident to elope from their facility. While AHCA inspectors were interviewing staff after the incident, the Health and Wellness Director expressed that she thought all residents were allowed to come and go from the facility as they wished. Additionally, the Administrator of the facility did not file an adverse incident report with the state following the incident.

Additionally, he developed and suffered from aspiration pneumonia, diarrhea, vomiting, dehydration, and malnutrition. These injuries resulted in hospitalization and the untimely death of Mr. Wrobel.

During a complaint inspection at The Windsor of Venice, it was found that staff failed to follow physician’s orders when aiding with self-administration of medication for eleven of the facility’s residents. Several medication errors were found during a review of the facility incident log report and the medication administration record.

According to the Agency for Health Care Administration’s inspection report, staff at The Windsor of Venice failed to follow physician’s orders when administering medication to residents. This resulted in one resident suffering an overdose. The resident was sent to the hospital once the error was realized.

Garbutt, Robert A. E/O vs. Windsor Reflections
Allegations: The estate of Robert Alfred Garbutt, represented by Betty E. Casey, sued Windsor Reflections for nursing home negligence in May 2018. While Mr. Garbutt was a resident at Windsor Reflections, he suffered from multiple falls resulting in skin tears, lacerations, and a head injury. The case’s complaint also alleges that Mr. Garbutt suffered from physical and psychological abuse from staff at the facility.

A complaint inspection in March 2023 found that staff at Windsor Reflections had failed to accurately update their records when giving residents medications. Review of internal documents revealed that several medications given to residents were not documented in their charts.
