Lauderhill Assisted Living Negligence is a Rapidly Increasing Issue
Lauderhill has more than its share of assisted living facilities and memory care facilities. In fact, Lauderhill is the home to Cannon Point, also known as “ALF row,” which has the highest concentration of assisted living facilities in Florida. In 2011, several state and federal agencies conducted surprise investigations of the facilities located at Cannon Point, where they found deplorable conditions: a live mouse glued to a trap, mice droppings in drawers and roaches.
The problem is that state and federal agencies will rarely close a facility that violates regulations, often opting instead of fine the facility and/or offer them an opportunity to fix the violations, no matter how egregious. For example, Briarwood Manor, an assisted living facility in Lauderhill, has been cited 100 times in the past five years by AHCA, but the facility remained open. An investigative report conducted by the Miami Herald found that “[a]t least five times, other agencies were forced to take the lead in shutting down homes when AHCA didn’t act.”
Neglect and Abuse Inside Lauderhill Long Term Care Facilities
More recent reports of nursing homes and assisted living facilities in Lauderhill still echo the need for private parties to be vigilant regarding the care of their loved ones in these facilities. State surveys and resident complaints indicate that a grandmother would not be changed despite the fact that she called for help to do so for over an hour and a half. The reviewer’s grandmother, unsurprisingly, developed several urinary tract infections and septic shock. Another public complaint stated that a Lauderhill nursing home staff’s failure to monitor her mother’s food and water intake resulted in fecal impaction, significant weight loss and ultimately, wrongful death.
Residents of assisted living facilities, in particular, are at additional risk. In 2014, a 61-year-old man, Peter Mack, was arrested for punching a 94-year-old resident in the face at Heartland of Lauderhill. A staff member noticed the assault and forced the two apart and called the police. Yelp reviews of Heartland of Lauderhill since this incident show that individuals walking into another resident’s room is common. One reviewer noted a man went into her mother’s room and came out with a handful of her meal, spilling it all over the floor. She also stated that the room and bathroom were not properly cleaned, even after the cleaning crew had allegedly gone through it. Most disturbingly, this reviewer stated that upon checking into the facility, her mother’s medical records stated that she had bedsores, when she did not. When the reviewer asked about this, no one was able to give her an answer why this was included in her mother’s medical records. The reviewer opined that this is most likely done to avoid legal liability later on when a patient did develop bedsores.
Although leaving a nursing home resident alone in a hallway does not appear to rise to the legal level of neglect, Florida’s Chapter 400 lists, among resident’s rights, “the right to be treated courteously, fairly, and with the fullest measure of dignity.” Leaving a wheelchair bound resident alone in a hallway is not only degrading for the resident, but also increases the risk of falls and other injuries.
