Levittown PA Nursing Home Abuse Law News
In 2015, then State Attorney General Kathleen Kane sued a national nursing home chain, Golden Living, “for chronic understaffing and failing to provide adequate care.” This included the notorious case of state inspectors finding maggots in a resident’s feeding tube. The company operated 36 homes in Pennsylvania, which were subsequently transferred to new owners.
With a history of providing such poor care, it would be reasonable to assume that new ownership of these facilities would result in better care. However, an investigative report by PennLive revealed that one year after the facilities were transferred, “nearly two-thirds of those homes were cited just as often or more frequently for care-related problems.”
According to a family who lost a matriarch shortly after her stay at a facility formerly operated by Golden Living, one of the facility continued to suffer from unsanitary conditions dirty rooms with food on the floor, stained mattresses, and the pervasive smell of urine and feces. The Mantheiy family alleged that the facility failed to provide adequate care: Rick Mantheiy’s mother was often left in bed as there was no one to help her into her wheelchair. She was also unable to travel to the bathroom alone. Eventually confinement to a bed led to the development of a large bed sore. Staff claimed that the sore was healing without issues; an examination of the sore showed that it was a large wound, deep enough that her tailbone could be seen. Despite instructions from a specialist to turn the Ms. Mantheiy every one to two hours, the bed sore only worsened as no one followed these instructions. During this time, Ms. Mantheiy also lost her ability to speak and seemed “dazed.”
Desperate to move her, yet finding that other facilities would not accept Ms. Mantheiy with such a large bed sore, the family admitted her into the emergency room of a hospital. Six weeks later, she was transferred to another nursing facility. Ms. Mantheiy was re-admitted to the hospital shortly thereafter due to septic shock. She passed away a week later.
Golden Living facilities were not limited to central Pennsylvania, however, with some former facilities located in eastern Pennsylvania. Although none are located in Levittown, a suburb of Philadelphia whose neighborhoods are located in four municipalities, understaffing of nursing homes is not limited to those facilities formerly operated by Golden Living. For example, PennLive compiled a database of Pennsylvania nursing homes based on Medicaid data. A search for nursing homes in the Levittown area shows that its sole nursing home Statesman Health and Rehab Center, received a “low” score for staffing, with residents receiving only 0.79 hours per day of care by a Registered Nurse.
Langhorne Gardens Health & Rehabilitation Center, another nursing home located near Levittown in Bucks County, suffers similarly bad reviews. Former residents recalled dirty bathrooms upon arrival, laundry issues, and supplies being replaced with cheaper alternatives. A family member of a former resident believed that the residents were being overmedicated without the family’s approval and noted that her relative became much more alert after she was moved to another facility.
It is important to note that both of the above facilities are for-profit organizations. A recent study found that “[o]lder adults who live in for-profit nursing homes are nearly twice as likely to have health problems linked to poor care than those in nonprofit nursing homes.” The study was conducted by Lee Friedman, an associate professor of environmental and occupational health sciences at the University of Illinois at Chicago. He stated that for-profit facilities often paid their administrators more, which means less pay for the remaining staff. This meant that many for-profit nursing homes have underpaid and overworked staff, leading to neglect and/or abuse of the residents. While 14 out of the 32 nursing homes in Bucks County are non-profit organizations or run by the county, Levittown’s sole nursing home is a for-profit organization.
