More About Pompano Nursing Home Abuse and Assisted Living Facility Malpractice
Pompano Beach is one of the most popular vacation home cities in the U.S. and is the home to six (6) nursing homes and thirteen (13) assisted living facilities of varying sizes. An up-and-coming locale in southeastern Florida, Pompano Beach provides easy access to Fort Lauderdale and Miami, yet remains far away enough to provide a quiet respite from its larger neighbors.
With a population of approximately 99,800 according to the U.S. Census in 2010, and a senior population of 19%, Pompano Beach provides a variety of long-term and rehabilitation facilities. However, some of these facilities – both nursing homes and assisted living facilities – appear to be negligent in their care, and reports of horrific abuse have been reported in the news.
News About Pompano Beach Nursing Home Abuse and Neglect
In November 2017, a daughter of a 94-year old resident of a Pompano Beach nursing home placed hidden cameras in her father’s room as she suspected her father was experiencing abuse. Her elderly, frail father suffered from dementia and had lost the ability to speak. The video, which was released to Local 10 News, shows a Certified Nursing Assistant roughly attempting to change the resident, and hitting him several times. At one point, she jerks him from the bed, and as he attempts to stand and gain his balance, she shoves him back into a chair before hitting him on the head. In another instance, the video shows the same Certified Nursing Assistant splashing and pouring mouthwash over the resident, as he cringes and attempts to cry out. The family sued the Pompano nursing home alleging negligence, abuse and neglect, claiming that the alcohol in the mouthwash dried out the resident’s skin, thus causing bedsores and ulcers, which ultimately led to the resident’s death.
Abuse of this nature is especially egregious. Keep in mind that neglect of residents is equally unlawful. A reviewer of The Court at Palm Aire, an assisted living facility in Pompano Beach, stated that call lights were “hardly ever” answered that “my mom was only sent here for rehab and she never had the chance to come back home.” Another reviewer stated that when a family member stayed at this particular facility, although the staff seemed friendly and the nurses competent, complaints of pain made by both the resident and family members of the resident to the staff resulted in no action. Eventually, it was stated that this resident was rushed to the hospital “in critical condition.”
The Orlando Sentinel, in an article regarding the employment of those with criminal records as caregivers, found that at one Pompano Beach assisted living facility failed to properly screen its employees. As a result, a resident with cancer could only watch as a nurse’s aide robbed her of $165. Knowing that the resident could not move to stop her, the aide went through the resident’s nurse to steal the cash, despite the resident’s request that she stop.
In another Broward facility, patients were left unattended in bed. One poor elderly woman got caught in her bed rail, causing a femur fracture.
The examples above are admittedly severe cases. Florida state and federal regulations exist to ensure that residents are provided proper care, and in the case of nursing homes, federal regulations state that the “resident has the right to be free from verbal, sexual, physical, and mental abuse, corporal punishment and involuntary seclusion.”
