The Estate of Gene H. Marcus, by and through Maxine Evelyn Marcus, Personal Representative vs. Extended Care Portfolio Florida Tenant, LLC
Allegations: The complaint alleges that Mr. Gene H. Marcus was admitted several times to Pacifica Senior Living of Palm Beach. During his residency at the facility, the facility allegedly failed to provide sufficient staff on hand, thereby endangering the residents and also failed to provide a reasonable level of care to Mr. Marcus. Mr. Marcus subsequently suffered several falls that resulted in serious injuries, including a subdural hematoma, skin tears and lacerations to his head, hand, face, and arms. Mr. Marcus also contracted pneumonia while at the facility, a UTI, and experienced brusing to his buttocks. According to the complaint, Mr. Marcus died as a result of his injuries in August 2015.
Rosanne Ruby, as Personal Representative of the Estate of Phillip Mascillino vs. Extended Care Portfolio Florida, LLC, d/b/a Pacifica Senior Living of Palm Beach
Allegations: Mr. Phillip Mascillino was a resident of Pacifica Senior Living of Palm Beach who, according to the complaint, passed away as a result of injuries sustained due to the negligence of the facility. Mr. Mascillino suffered a fall that resulted in a hip fracture while at the facility as the staff failed to supervise him properly.

Complaint Regarding Deficiencies Dated 11/22/2019
AHCA found that the facility failed to notify a physician after a resident exhibited a change in condition, which involved a resident punching someone at the ALF. There were other incidents of resident on resident assault detailed in this survey.
Complaint Regarding Deficiencies Dated 9/19/2019
AHCA found that the facility failed to adequately record that a resident was an elopement risk and did not provide the agency with additional information regarding that resident’s departure from the facility. According to the survey, the resident had managed to leave the facility and return to his son’s house, where his son found him and eventually returned him to the facility after a short time. The facility was unable to locate the resident during this time.
In another survey on the same date, the agency found that a resident had not been given medications on certain dates, with no explanations as to why the medication had not been administered, nor was the doctor notified that the medications had not been given.
Complaint Regarding Deficiencies Dated 6/19/2019
In an unannounced survey inspection, AHCA found that several residents had suffered from bug bites but that no further testing was conducted although medication was prescribed by the doctor. Elopement policies were also not properly observed as a resident had left the facility around 6:00 a.m. and was located by local police approximately 20 minutes later. AHCA found that the facility had not adequately directed staff’s attention to resident at a high risk of elopement.
Complaint Regarding Deficiencies Dated 5/24/2019
AHCA found that one resident’s admission at the facility may not be appropriate as he needed constant supervision to prevent him from eating inedible products, choking and touching other individuals, including residents. Although staff believed his conduct was harmless, other residents had expressed they were somewhat fearful of that resident.
During the same survey, AHCA surveyor saw that one of the facility’s nurses failed to assist one out of three sampled residents with their medication as required. Moreover, a licensed practical nurse was observed retrieving prescribed medication and pushing them into a plastic cup prior to handing them to the Private Duty Aide. As a licensed practical nurse, she later admitted that she should not have done this.
