Allegations: This case involved allegations against Hialeah Nursing and Rehab for failure to care plan, monitor, and supervise a high-risk resident. The resident developed pressure ulcers and infections that led to his deterioration. As a result of his injuries, the resident suffered from physical impairment, disfigurement, and mental anguish.
Perez v. Hialeah Enterprises LLC, d/b/a Hialeah Nursing and Rehabilitation Center
Allegations: This case involved allegations against Hialeah Nursing and Rehab for failure to provide adequate care and appropriate services to a resident. The resident developed bedsores and deteriorated under the care of the facility. As a result, the resident suffered from physical impairment, disfigurement, mental anguish, and subsequently died.
Dangond, as Personal Representative of the Estate of Lopez v. Hialeah Enterprises LLC, d/b/a Hialeah Nursing and Rehabilitation Center
Allegations: This case involved allegations against Hialeah Nursing and Rehab for failure to properly monitor, supervise, and provide care to a resident. While at the facility, the resident had multiple falls, with related traumatic injuries, requiring her to be transferred to the hospital. The resident suffered bodily injury and resulting pain and suffering.
Fines Imposed Against Hialeah Nursing and Rehab
Hialeah Nursing and Rehab was fined on May 11, 2018, by the Agency for Health Care Administration for a criminal background screening violation. The facility did not ensure that background screenings were still valid for employees within the facility and did not ensure that background screening results were reviewed by the Agency. The facility was required to pay the Agency for Health Care Administration $3,500.00. Hialeah Nursing and Rehab was also fined on December 13, 2016, by the Agency for Health Care Administration for failure to provide valid background screening for an employee who had lapses in employment. For this violation, the facility was required to pay the Agency for Health Care Administration $500.00. Not having the correct staffing procedures can lead to shortages which ultimately are a main cause of resident neglect.
Deficiencies at Hialeah Nursing and Rehab for Resident Care Violations
- A September 13, 2019, Inspection at Hialeah Nursing and Rehab revealed the facility failed to implement policies and procedures to prevent abuse. The facility did not investigate and report an allegation of verbal abuse between two residents.
- A May 24, 2018, Inspection at Hialeah Nursing and Rehab revealed the facility failed to honor the resident’s right of self-determination and did not provide the proper food choices to a resident. Furthermore, the facility did not honor the resident’s grievances and make a prompt effort to resolve them.
- A June 29, 2017, Inspection at Hialeah Nursing and Rehab revealed the facility failed to care for and respect a resident during daily activities and dining. The resident was not capable of eating nor of understanding television programming, nonetheless, the facility placed the resident in a position where she watched others eat and positioned the resident against the wall.
