Your Miami Nursing Home Abuse Law Firm
Nursing home abuse and neglect in Miami is inexcusable. As one of Florida’s largest cities, Miami has a large senior population. Unfortunately, Miami’s elderly are sicker than most seniors nationwide. A recent 2016 study showed that Miami-Dade County’s older population (65 years of age or more) faced unprecedented health care challenges, including more acute illnesses and chronic diseases than the national average. Miami has recently made efforts to focus on its seniors, even going so far as to budget county funds to study its elderly population. Tragically, Miami’s nursing homes do not always meet the needs of this frail patient population. Failing to provide for resident needs is considered Miami nursing home abuse and neglect.

Florida Nursing Home Abuse was ‘Discovered’ in Miami-Dade County
The early 1980s were a tumultuous time for Miami. Amid a public relations nightmare, Miami was ground central for cocaine importation and resulting street crime. Sadly, Miami also experienced widespread and systemic nursing home neglect. Miami’s elderly were dying in record numbers as greedy facility owners put their profits ahead of resident safety. Miami’s nursing homes were packed with patients and chronically understaffed. Our attorney Jeffrey Fenster practiced nursing home abuse law in Miami at that time, and describes it as the wild west. At that time, there was little government oversight and it was difficult to hold Miami nursing home’s accountable for neglect in lawsuits, given the laws on the books at that time. As expected, Miami nursing home abuse was rampant.
The Miami Grand Jury Investigation that Exposed Systemic Nursing Home Abuse
A 1980 Miami-Dade County Grand Jury investigation into Miami nursing home abuse, spearheaded by State Attorney Janet Reno, concluded that:
- Nursing home neglect was rampant in Miami;
- The regulation, investigation and enforcement process was insufficient and not working;
- The laws needed to be amended to add more ‘teeth’ to deter bad nursing home behavior.
The Grand Jury investigation made waves which eventually made ripples in Tallahassee. Florida lawmakers took note of Miami’s nursing home abuse problem and the Florida legislature was shocked to learn that sixty percent of Miami nursing homes provided “unacceptable or consistently very poor care” for residents. After recognizing that the existing laws did not adequately protect vulnerable residents, the Florida Legislature passed the “Nursing Home Residents Rights Act” in response to the Grand Jury’s findings. The Nursing Home Residents Rights Act was passed to empower nursing home abuse victims statewide to sue negligent nursing homes for elder abuse and neglect.
Miami Nursing Home Abuse & Neglect; A Continuing Problem Today
While nursing home regulation has certainly improved since the 1980s, Miami is still suffering from widespread elder neglect inside its long-term care facilities. In a cruel twist of irony, a recent Miami grand jury investigation conclude that Miami’s assisted living facilities are systemically neglectful of their residents. The Miami-Herald has run a three-part series on Miami’s nursing home abuse problem, titled “NEGLECTED TO DEATH.” It appears that history if repeating itself.
