Fines Imposed Against Brighton Gardens of Tampa

Terry v. Solomon Holdings I, d/b/a Brighton Gardens of Tampa; Sunrise Senior Living Services, Inc.
This case involved allegations of negligence resulting from a fall at the facility when a fracture was left untreated. Upon transportation to the hospital ten days after the fall, it was discovered that the fracture resulted in paraplegia and the resident was not a candidate for surgery due to the lapse in time from the fall and treatment. The resident suffered bodily injury and resulting pain and suffering, as well as disability and disfigurement.
Lucy Licata v. Solomon Holdings I; Sunrise Senior Living Services, Inc; and Carla Russo (as to Brighton Gardens of Tampa)
This case involved allegations of negligence resulting from the facility’s failure to monitor significant signs and symptoms of infection in the resident, failing to provide adequate and appropriate skin care assessments, and failing to prevent the development and/or worsening of ulcers on the resident. The resident suffered bodily injury and resulting pain and suffering as well as disability and disfigurement.
Deficiencies at Brighton Gardens of Tampa for Resident Care Violations
A September 25, 2017 Inspection at Brighton Gardens showed that the facility failed to maintain personnel records which contained documentation verifying an employee’s freedom from signs or symptoms of a communicable illness. Furthermore, the facility failed to ensure staff completed required training within 30 days of employment.
In addition, a September 11, 2019 Inspection at Brighton Gardens showed that the facility again failed to reveal whether a staff member was free from a communicable illness. The inspection also demonstrated that multiple staff members did not complete the required hours of training for employment.
A survey by the Department of Health and Human Services completed on October 31, 2019 found that the facility failed to ensure that an accurate comprehensive care plan was developed and implemented for a sample of residents. The survey also found that the facility failed to ensure monitoring to support the administration of medication for one out of seven sampled residents.
