Allegations: Due to neglect from the staff at ProMedica Lely Palms, Nicholas Triana Sr. developed bedsores. He was not provided with appropriate wound care, which led to his bedsores deteriorating and becoming infected with sepsis. Jolynn Gates, Mr. Triana’s daughter, sued ProMedica Lely Palms for nursing home negligence after her father’s death.
Anthony, Willie E/O vs. ProMedica Skilled Nursing and Rehabilitation Lely Palms
Allegations: While a resident in the facility, Willie Anthony suffered multiple preventable falls. After a fall on July 20th, 2021, Mr. Anthony’s wife, Audrey Anthony, noticed a large bump on his head. She was also concerned with his altered mental status. Mrs. Anthony had her husband transported to the hospital for evaluation. At the hospital, Mr. Anthony was diagnosed with a subdural hematoma, also known as a brain bleed. He ultimately passed on August 21, 2021. Mr. Anthony’s death certificate listed his manner of death as accidental due to a traumatic intracranial hemorrhage.
Houck, Herbert F. E/O vs. ProMedica Skilled Nursing and Rehabilitation (Lely Palms)
Allegations: During his time at ProMedica Lely Palms, Mr. Herbert Houck suffered from dehydration, medication errors, infections, and falls. Due to one of the falls, Mr. Houck was hospitalized for a right hip fracture. The estate of Mr. Houck sued ProMedica Lely Palms for Mr. Houck’s wrongful death.
Deficiencies at ProMedica Skilled Nursing and Rehab Lely Palms for Resident Care Violations
February 22nd, 2022, Inspection at ProMedica Skilled Nursing and Rehabilitation (Lely Palms)
A complaint inspection took place at the facility after multiple residents raised concerns about call light response times. According to interviews with the residents, it was discovered that staff at ProMedica (Lely Palms) took anywhere from twenty minutes to an hour to respond to call lights. During an interview with one of the resident’s family members, it was noted that the late response times led to the resident getting out of bed on their own and falling.
April 14th, 2021, Inspection at ProMedica Skilled Nursing and Rehabilitation (Lely Palms)
This inspection revealed that ProMedica (Lely Palms) failed to maintain a safe, comfortable, and sanitary environment for their residents. Inspectors visiting the facility on April 14th, 2021, observed heavily soiled bathroom floors, cracks and holes in multiple walls, and rusted toilet seats.
August 8th, 2019, Inspection at ProMedica Skilled Nursing and Rehabilitation (Lely Palms)
An inspection at ProMedica (Lely Palms) in 2019 found that staff had failed to provide a resident with her prescribed pain medications. The resident had been suffering from pain from a hip fracture that was unable to be operated on.
