Allegations: Zulma Gonzalez filed a lawsuit against Delaney Park Health and Rehabilitation on behalf of the estate of Ms. Albino Fuentes. According to the case’s complaint, staff at Delaney Park failed to adequately monitor, prevent the development of respiratory failure, and timely transport Ms. Albino Fuentes to the hospital. As a result of these failures, Ms. Albino Fuentes passed away on June 21st, 2022. The complaint against Delaney Park Health & Rehab alleges a nursing home wrongful death claim.
Mercado, Carolyn E/O vs. Delaney Park Health and Rehabilitation Center
Allegations: Ms. Mercado’s legal guardian, Cheryl Robinson, acted on her behalf in filing a case against Delaney Park Health and Rehabilitation Center following Ms. Mercado’s death. While Ms. Mercado was in the facility, she suffered from extreme weight loss, the development of a stage four bedsore on her coccyx, and the return of a deep tissue injury on her right heel. Ms. Mercado was transported to the hospital from Delaney Park, where she was treated for her injuries and a Covid-19 infection. Unfortunately, Ms. Mercado’s injuries from the facility shortened her life expectancy and led to her untimely death.
Deficiencies at Delaney Park Health and Rehabilitation Center for Resident Care Violations
March 3rd, 2023, Inspection at Delaney Park Health and Rehabilitation Center
This inspection resulted in Delaney Park Health and Rehabilitation Center being fined over $53,000. Inspectors determined through interviews and record reviews that the facility had failed to protect a resident from neglect. The resident, who had been diagnosed with multiple psychiatric and cognitive disorders, was not properly monitored by the facility’s staff. The resident had multiple suicide attempts prior to entering Delaney Park Health and Rehabilitation Center. While in the facility, he threatened to end his life. After speaking with a psychologist and a psychiatrist, the determination was made that the resident needed close supervision and his access to any potentially harmful items be revoked. Unfortunately, this advice was not followed, and the resident ended his life by using a shower hose in his bathroom to hang himself. The resident’s wife, who was also a resident at Delaney Park Health and Rehabilitation Center, found him and alerted staff.

This inspection resulted in a citation due to the facility failing to provide safe and appropriate respiratory care for a resident.
