Heartland Prosperity Oaks Nursing Home Lawsuits, State Violations and Complaints
Heartland Health Care – Prosperity Oaks, located at 11375 Prosperity Farms Road in Palm Beach Gardens, was cited in a $2,500 fine levied by the State of Florida’ Agency for Health Care Administration (AHCA). The Complaint against Heartland of Palm Beach Gardens alleges that the 120 bed nursing home was cited for a Class II deficiency found during a licensure survey. The Palm Beach Gardens skilled nursing facility has also faced multiple lawsuits for allegations involving nursing home negligence.

State of Florida’s Surveys and Inspections of Heartland Prosperity Oaks
During an unannounced inspection of the Palm Beach Gardens nursing home, state investigators found multiple violations which could cause residents harm. Based on personal observations and review of Heartland Prosperity Oaks records, it was determined that the nursing home was negligent in the following respects:
- Facility nurses failed to ensure adequate supervision for residents
- Heartland Prosperity Oaks failed to property prevent nursing home falls
- Heartland Prosperity Oaks violated the following Florida nursing home rules and regulations:
- A 12/21/2017 inspection resulted in a deficiency regarding care plans not meeting a resident’s needs.
- A 10/31/2018 inspection resulted in deficiencies for failing to provide treatment and care pursuant to orders, failing to ensure that the nursing home was free of accident hazards and failing to provide adequate supervision to residents to prevent accidents.
- A 2/7/2019 unannounced re-certification survey resulted in a 14 page deficiency write up.
- A 2/11/2019 fire life safety state inspection resulted in fire alarm safety violations.

Joan Upshur vs. Heartland Prosperity Oaks of Palm Beach Gardens FL LLC [2018 Case]
In this nursing home negligence lawsuit filed against Heartland Prosperity Oaks, the plaintiff alleged that Ms. Upshur’s surgical wound on her sternum opened up and that the Heartland staff failed to contact the surgeon or document the incident.
Lozott vs. Heartland of Prosperity Oaks [2018 Case]
In this medical malpractice and nursing home negligence lawsuit filed, in part, against Heartland Prosperity Oaks, the plaintiff alleged that Mr. Lozott fell off of a ladder in 2016, resulting in a St. Mary’s hospitalization. While in the hospital, Mr. Lozott developed a Stage II pressure ulcer on his sacrum. Mr. Lozott was then admitted into Heartland Prosperity Oaks, where it is alleged he was not provided appropriate assistance with turning and re-positioning. As a result, it is alleged the pressure ulcer worsened, and he developed a UTI.
Estate of Panaro vs. Heartland Prosperity Oaks [2015 Case]
In Panaro vs. Heartland Prosperity Oaks, Mr. Panaro was admitted into Heartland of Prosperity Oaks on 1/23/2013. He remained a resident at the facility until 2/7/2013. The plaintiff alleged that proper care was not provided to Mr. Panaro, and as a result, he developed pressure sores and infection. The Complaint alleges wrongful death damages.
Estate of Linderman vs. Heartland of Prosperity Oaks [2014 Case]
This is another nursing home negligence lawsuit filed against Heartland Prosperity Oaks. In this case, the Estate alleged violations of Chapter 400 residents rights. It is alleged that Alfred Linderman suffered pressure sores because staff did not reposition the patient in bed, nor was a proper pressure-relieving mattress provided.
